Terms of Service
For the use of HoogteVrij
Laatst bijgewerkt: 4 september 2026
1. About us
HoogteVrij is offered by VaViGo Media & Entertainment through its VaViGo Development division. VaViGo Media & Entertainment is registered at Prins Bernhardstraat 7, 2671 ER Naaldwijk, the Netherlands, under Chamber of Commerce number 99618559 and VAT number NL005399259B56. In these Terms, “VaViGo”, “we”, “us” and “our” refer to VaViGo Media & Entertainment. You can contact us at info@vavigo.nl or visit www.vavigo.nl.
2. Acceptance
These Terms of Service apply when you access or use the HoogteVrij website, web app or any other version of the service. By using HoogteVrij, you agree to these Terms. If you do not agree, do not use the service.
If you are a consumer, any mandatory rights available to you under applicable law remain unaffected.
3. The service
HoogteVrij helps users plan and follow routes for vehicles with an increased height. It may allow you to enter vehicle height, an origin and a destination, compare route alternatives and receive turn-by-turn guidance.
The service relies on third-party mapping and routing data. HoogteVrij is an assistance tool, not a certified vehicle, transport or traffic-safety system.
4. Your responsibilities
You are responsible for:
- correctly measuring and entering the vehicle’s total height, including cargo, roof racks, air conditioning units, antennas and any protruding parts;
- checking that the vehicle, cargo, weight, width and length are suitable and lawful for the route;
- following traffic signs, road closures, local rules and instructions from authorised persons;
- driving safely and operating the app without distraction.
Whenever possible, set the route before driving or have a passenger operate the app. Never use HoogteVrij in an unsafe or unlawful manner.
5. Height data and route guidance
Map and height data may be missing, outdated, inaccurate or incorrectly interpreted. A calculated route therefore does not guarantee sufficient clearance at every bridge, tunnel, passage, tree, cable, temporary structure or other obstacle.
Traffic signs and actual road conditions always take priority over information shown in HoogteVrij. Stop safely and choose another route if you are uncertain.
6. Permitted use
You may use HoogteVrij only lawfully and for normal navigation purposes. You must not:
- disrupt the service, bypass security or impose an excessive load;
- automatically scrape, extract or copy data without our written permission;
- copy or commercially exploit the app, source code, databases or design except where expressly permitted by law;
- use HoogteVrij for unlawful, dangerous or misleading activities.
7. Third-party services
HoogteVrij uses third-party services, including OpenStreetMap and OpenRouteService. Additional terms and licences from those providers may apply. We are not responsible for their changes, downtime or errors, although we take reasonable steps to limit the impact on HoogteVrij.
8. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Maintenance, outages, network issues or provider changes may temporarily limit features.
We may modify, improve or discontinue features. We will provide appropriate notice of a materially adverse change and give advance notice where required by law. You may stop using the service at any time.
9. Intellectual property
HoogteVrij’s software, trade name, design and original content belong to VaViGo or its licensors. We grant you only a personal, limited, revocable, non-exclusive and non-transferable right to use the service. Rights in map and route data remain with the relevant providers and contributors.
10. Privacy
Our Privacy Statement explains which personal data may be processed when you use HoogteVrij, why it is processed and the rights available to you.
11. Liability
VaViGo is liable for damage to the extent that it is the direct result of a breach attributable to VaViGo. To the extent permitted by law, VaViGo is not liable for indirect or consequential loss, lost revenue, loss of data, or damage caused by incorrect vehicle information, failure to follow traffic rules, or blind reliance on incomplete third-party data.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for wilful misconduct or deliberate recklessness by VaViGo and mandatory consumer rights.
12. Force majeure
VaViGo is not responsible for failure caused by circumstances beyond its reasonable control, including outages in internet, GPS, hosting, mapping or routing services, power failures, government action, natural disasters or cyber incidents despite appropriate safeguards.
13. Termination
You may end your use at any time by no longer using HoogteVrij and deleting locally stored app data through your browser. We may restrict or end access if you seriously breach these Terms or the law, or when necessary to protect safety or security.
14. Complaints and contact
Send questions or complaints to info@vavigo.nl. Describe what happened and, where safe, include the route, location and time. We will respond within a reasonable period.
15. Governing law
These Terms and the use of HoogteVrij are governed by Dutch law. Disputes are submitted to the competent courts of the Netherlands. If you are a consumer living in another EU country, you retain the mandatory protections and competent courts provided by the law of your country of residence.
16. Changes to these Terms
We may update these Terms when the service or the law changes. A new version applies from the date shown above and not retroactively. We will provide a clear in-app or website notice for material changes.
